1. Agreement to Terms

By engaging Smart Quality Painting for painting services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Smart Quality Painting provides residential painting services including:

• Interior painting
• Exterior painting
• Cabinet painting and refinishing
• Surface preparation and repairs
• Color consultation

3. Quotes and Pricing

3.1 Quote Validity

Written quotes are valid for 30 days from the date of issue unless otherwise specified. Quotes are based on the scope of work discussed during the inspection.

3.2 Price Changes

Additional work not included in the original quote will be charged separately. We will obtain your approval before proceeding with any work outside the original scope.

3.3 Payment Terms

• 50% deposit required upon acceptance of quote
• Balance due upon completion of work
• Payment methods: Cash, bank transfer, credit card
• Late payments may incur a 2% monthly charge

4. Scheduling and Delays

4.1 Weather Delays

Exterior painting is weather-dependent. We reserve the right to reschedule work due to adverse weather conditions without penalty.

4.2 Access Requirements

You must provide reasonable access to work areas. Delays caused by lack of access may result in additional charges.

5. Client Responsibilities

Clients are responsible for:

• Removing or securing valuable items from work areas
• Providing access to electricity and water
• Ensuring pets are secured during work hours
• Obtaining necessary body corporate or council approvals
• Notifying us of any hazards or special requirements

6. Warranty

6.1 Workmanship Warranty

We provide a 5-year warranty on interior painting and 7-year warranty on exterior painting, covering defects in workmanship under normal conditions.

6.2 Warranty Exclusions

The warranty does not cover:

• Normal wear and tear
• Damage from accidents, abuse, or negligence
• Structural defects or moisture problems
• Fading due to direct sunlight
• Work performed by others

7. Liability and Insurance

Smart Quality Painting maintains comprehensive public liability insurance and workers' compensation coverage. We are not liable for:

• Pre-existing defects or damage
• Damage to items not properly secured or removed
• Consequential or indirect losses
• Issues arising from client-supplied materials

8. Cancellation Policy

8.1 Client Cancellation

Cancellations made less than 48 hours before scheduled start may incur a cancellation fee equal to 25% of the quoted amount.

8.2 Our Right to Cancel

We reserve the right to cancel or suspend work if unsafe conditions exist or if payment terms are not met.

9. Dispute Resolution

Any disputes will first be addressed through direct communication. If unresolved, disputes will be subject to mediation before pursuing legal action. These terms are governed by Queensland law.

10. Intellectual Property

All content on our website, including text, images, and logos, is property of Smart Quality Painting and protected by copyright law.

11. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and effective immediately upon posting.
